Tiger Woods’ Ex-Girlfriend Does Not Recall Signing an NDA

As a Florida court is proving, being in a relationship with Tiger Woods is a complicated matter.

Attorneys for both Woods and his ex-girlfriend, Erica Herman, appeared before Judge Elizabeth Metzger in Martin County, Florida, on Tuesday. At issue is the validity of a non-disclosure agreement signed by Harman in 2017 after she began dating the famous golfer. Prior to that, Herman was employed by Woods as the general manager of his restaurant in Jupiter, Florida.

Woods’ attorneys argued that the document states any disputes from the agreement take place in private arbitration and not in a public courtroom.

The argument from Herman’s attorney is that she did not recall signing the NDA, so they are arguing that her signature could have been forged.

In addition, Herman’s attorneys say the contract should be invalidated because if she did sign it, the argument is that she was forced to by Woods in order to keep her job.

Judge Metzger said that she would make her ruling in writing, but from her comments, it seems like it was Woods’ attorneys who had a better day in court.

“Contract law tells me I look at the document, and … I ask, ‘Is it valid on its face?’ I’ve got dates, I’ve got signatures. I’ve got terms,” she told Herman’s attorney. “Tell me why it’s not valid on its face.”

The attorney, Benjamin Hodas, questioned the validity of the signature but stopped short in saying that Herman didn’t sign the document.

If the judge’s ruling goes in favor of Woods, any negotiating about the validity of the agreement would take place behind closed doors.
