Florida Judge Rules in Favor of Tiger Woods as Ex-Girlfriend Sought to Get NDA Tossed
After it appeared in court last week that she was leaning toward a favorable ruling for Tiger Woods in a case brought on by ex-girlfriend Erica Herman, Circuit Judge Elizabeth Metzger did just that late Wednesday.
Herman was looking to have a nondisclosure agreement she signed in 2017 thrown out on the basis that Woods had committed sexual harassment against her. But when pressed in court last week, Herman’s lawyers did not give specifics. Judge Metzger, in a written ruling, called the allegations “vague and threadbare.”
Metzger wrote:
“Herman has had the opportunity (to) provide factual specificity for any claim relating to sexual assault or sexual harassment, however, she has not done so.”

Metzger said that an agreement that was negotiated and signed in 2017 by both Woods and Herman is valid. Any disputes over that by Herman must now be handled behind closed doors in mediation instead of in a public courtroom.
Benjamin Hodas, Herman’s attorney, argued last week that Herman is unsure whether she signed the document presented to the court, but Metzger said that is a separate issue that can be handled in arbitration.

The document appears to have been created when Herman and Woods began dating, and she moved into his home. Herman alleges she was tricked into moving out of the home last October when Woods ended the relationship. Prior to their relationship starting, Herman had worked for Woods in the capacity of general manager at his restaurant in Jupiter, Florida.
