TaylorMade Accusing PXG of Copyright Infringement

Often, you will see different golf brands fighting for sales and endorsements among golfers from the amateur level all the way up to the professionals. In this rare occasion, however, two brands are taking a battle to the court system.

TaylorMade and PXG have been going at each other’s throats for months now based upon the release of irons from both of the brands. The original legal fight began back in September, when PXG filed a suit against TaylorMade, claiming that the P790 Irons that they were about to release infringed upon 8 of PXG’s patents. PXG then attempted to get a  preliminary injunction and temporary restraining order to stop the sale of the P790s but were denied.

Now, TaylorMade is fighting back, filing a suit against PXG, claiming that it is actually their company that is violating at least seven TaylorMade patents. If TaylorMade’s suit is successful, the court will prevent PXG from selling most of their products, including but not limited to PXG 0311 irons, PXG Woods, as well as their 0811 drivers and 0341 fairway woods.

On top of filing a countersuit against PXG, TaylorMade’s lawyers are also requesting that the case that PXG filed against them be thrown out for a lack of plausible proof that the P790s violated any PXG patent. In the request for a dismissal, TaylorMade stated that “because PXG’s complaint fails to map the features of the P790 irons onto the limitations of even one claim, the complaint should be dismissed.”

It isn’t a surprise that TaylorMade would ask for the courts to throw out the suit that PXG has against them, but the move to countersue the company for the same thing is quite aggressive. Even more so when the company is not asking PXG to stop producing one product, but virtually asking them to end all of their business because of an infringement. It’s the epitome of, you hit me, we hit you back but harder.

Only time will tell if TaylorMade’s suit will have more success than PXG’s did but if you’re a player in possession of PXG golf clubs, you may want to hold onto them. If PXG is forced to stop making a large majority of those products, they may become a lot more valuable on the open market.
