Tiger Woods’ Attorney Calls Erica Herman ‘Jilted Ex-Girlfriend’ in Court Document

Tiger Woods’ response to a lawsuit filed against a trust he established and one filed against him personally by ex-girlfriend Erica Herman came in the form of court documents on Monday.

Attorney J.B. Murray filed documents in Florida that refer to Herman as a “jilted ex-girlfriend” whose position is “meritless.”

Most of the filings discuss Herman’s filing last week looking to nullify the non-disclosure agreement (NDA) she signed with Woods when the couple began dating in 2017.

In October, Herman sued a trust established by Woods after she claims she was told to pack for a short vacation and then was informed she was being locked out of the Jupiter, Florida, mansion she lived in with Woods.

Herman stated she had an oral tenancy agreement with Woods to live in the mansion another five years and is claiming around $30 million in damages. In court documents filed by Woods’ attorney, the golfer claims there was no agreement, and Herman was just a guest at the residence.

Last week, she filed separately against Woods in looking to get out of the NDA via the federal Speak Out Act, which says that an NDA is not enforceable in cases of sexual abuse or harassment.

“Ms. Herman argues that she cannot be required to arbitrate her claims because a new federal statute … provides that a party to an arbitration agreement cannot be required to arbitrate a ‘sexual assault dispute’ or a ‘sexual harassment dispute,’” said the filing by Murray.

“Ms. Herman’s position is utterly meritless. Nevertheless, (the statute) makes it clear that whether the federal statute applies and thus bars an arbitration ‘shall be determined by a court, rather than an arbitrator.’ Accordingly, Defendant asks this Court for an order determining that (the statute) does not apply to the claims in this case.”

In Herman’s lawsuit, she is calling for an arbitrator to dissolve the NDA. In the lawsuit filed against the trust, Herman’s attorney answered a question about whether the case involves allegations of sexual abuse with a “no,” but the same question was answered “yes” in last week’s lawsuit.

Woods’ attorney filed in court records Monday:

“For more than six years, Ms. Herman enjoyed the benefits of her agreement. Now that her relationship with Mr. Woods has ended, however, she seeks to disregard her obligation to arbitrate disputes with Mr. Woods. Even worse, she seeks to justify her refusal to arbitrate by making salacious and insidious implications to federal statutes applying only to claims relating to sexual assault disputes and sexual harassment disputes.”

Woods’ 9,700-square-foot mansion has been his home since 2010. It’s part of a 12-acre property that holds five buildings and overlooks the Atlantic Ocean.
